Does GetQuorum collect Voting Certificates?
For Florida communities, Voting Certificates are legal documents used to designate one specific person to vote for a unit. These documents are part of the association's official records and must be managed directly by the Board or Property Manager.
No, GetQuorum does not collect Voting Certificates
GetQuorum is a voting and notice platform, not a legal repository for association records. Our policy regarding Voting Certificates is as follows:
-
Association Responsibility: The association is responsible for collecting, verifying, and maintaining all Voting Certificates in accordance with their specific Bylaws.
-
Roster Integration: Instead of collecting the forms ourselves, we ask the association to provide a Designated Voters List (based on the certificates they have on file). We then use this list to ensure the correct person receives the digital voting invite.
-
Data Cleaning: GetQuorum does not verify the legal validity of a certificate. We rely on the Property Manager to ensure the "Designated Voter" column in their Excel upload is accurate.
What is a Voting Certificate?
A Voting Certificate is a form that names a Designated Voter for a unit. This is typically required in two scenarios:
-
Multiple Owners: When a unit is owned by more than one person (e.g., two friends or siblings), a certificate designates which one has the authority to cast the vote.
-
Entity Ownership: When a unit is owned by a corporation, trust, or LLC, a certificate identifies the individual authorized to vote on the entity's behalf.
How to Manage Certificates Effectively
To ensure your digital campaign runs smoothly, the association should:
-
Review Governing Documents: Confirm whether your Bylaws actually require Voting Certificates (some modern documents have removed this requirement).
-
Maintain an Updated List: Keep a master Excel file of all designated voters so it is ready for your GetQuorum campaign setup.
-
Audit Annually: Reach out to owners before the meeting season to see if ownership has changed or if a new voter needs to be designated.
